TERMS & CONDITIONS

PRIZE DRAW TERMS AND CONDITIONS (“TERMS AND CONDITIONS”)  

These Terms and Conditions are applicable to anyone entering a prize draw (“the Prize Draw”) promoted by us, Garson Esales Ltd. T/A Pollylop (the “Promoter”).  

By entering the Prize Draw you (“You”, the “Entrant”, “Your”) accept these Terms and Conditions and agree to be bound by them. If You do not accept these Terms and Conditions, you should not enter the Prize Draw. To the extent that there is a conflict between these Terms and Conditions and any specific terms and conditions on the Prize Draw webpage, the terms and conditions on the relevant Prize Draw webpage will take precedence.  

1. Prize Draw  

The Prize Draw is promoted by the Promoter. 

 • The closing date (“Closing Date”) for entries to the Prize Draw will be shown on each Prize Draw webpage.  

• The Closing Date will not be extended except in exceptional circumstances, where these are beyond the Promoter’s control. Minimum 'paid entries' threshold of 500 to be achieved before draw.

2. Eligible Entrants  

• All entrants must be over 18 years old.  

• By entering the Prize Draw, You confirm that You are eligible to enter and to claim the prize (the “Prize”).  

• You are responsible for ensuring that entering the Prize Draw would not be illegal in the country where You reside.  

• Employees of the Promoter and their immediate families or households are not permitted to enter the Prize Draw.  

3. Prize  

• Prizes are listed on each Prize Draw webpage with a description of the Prize.  

• The Promoter will, wherever possible, provide a representational image of the Prize, but shall have no liability if it does not do so.  

• Prize images may be subject to copyright and Prize Draws are not sponsored or promoted by any brand associated with a Prize (unless otherwise stated and declared). 

• Descriptions of Prizes are provided without a warranty of any kind.  

• The Promoter reserves the right to substitute a Prize with a reasonable equivalent at its sole discretion, if circumstances beyond its control makes it necessary to do so.  

• There is no cash alternative to a Prize. The Prize includes accomodation (but) excludes flights and transfers and any other associated costs  

• Prizes are not transferable.  

• A Prize winner is responsible for all taxes and duties in connection with their receipt of a Prize.  

• The Promoter may require You to provide proof that You are aged 18+ and otherwise eligible to in order to enter or to receive a Prize.  

4. How to enter  

• All Prize Draws can be entered either by  

(a) paying to enter or gaining a free entry 

FREE entries are only allowed upto a closing date (August 31st 2026)

Paid entries thereafter at £1/entry

FREE entry includes (but not limited by) subscribing to our email list via the website www.pollylop.com or following us via social media accounts. 

(b) subscribing to a social media account of the Promotor for free online via related accounts such as www.facebook.com/pollylopswimwear, www.instagram.com/pollylopholiday or www.youtube.com/@Pollylop-Swimwear   

(c) making a purchase at www.pollylop.com. Multiple entries will be allowed by the same account for each separate invoiced purchase made 

Only 1 entry per person for online social media subscriptions. 

• In order to enter a Prize Draw (whether paid or for free) it is necessary to first create an online account by way of www.pollylop.com 

• Each entry (whether paid or for free) will count as one entry to the Prize Draw.  

• Entrants may make multiple entries (for each separate purchase from www.pollylop.com) to each Prize Draw and may enter more than one Prize Draw at a time.  

• Where applicable, any limitation on numbers of entries to a Prize Draw will be shown on the Prize Draw webpage.  

• Free postal entry route:  

o Entrants can enter any Prize Draw for free by post. Please see the detailed instructions on the relevant Prize Draw webpage for details of how to enter the Prize Draw by post.  

o Each postal entry sent to the address stated on the Prize Draw website will count as one entry to the Prize Draw.  

o Only pre-paid entries submitted by first and second class post and received by the Closing Date will be accepted.  

o Bulk entries submitted by post will not be accepted, nor will hand delivered entries, or entries posted through the letterbox.  

• Free entry route at an Event:  

o In addition to the free postal entry route, Entrants may also be able to enter a Prize Draw for free during an Event.  

o Entry will be available via an onsite iPad and/or manual form completion provided by the Promoter.  

o Registration for an account and entry of personal details will be required to enter a Prize Draw by this method. However, there is no requirement to pay to enter via the free entry route at an Event.  

o During an Event, the availability of the free entry route will be prominently displayed.  

o Each entry at an Event will count as one entry to the Prize Draw.  

o When entering a Prize Draw during an Event, free entrants must accept these Terms and Conditions in order to participate.  

o Postal and other free entries (submitted during an Event) will be treated in the same way as paid entries to the Prize Draw.  

o All Prize Draw entries that are received after the Closing Date will be automatically disqualified.  

o No responsibility will be accepted for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind.  

o Proof of sending an entry will not be accepted as proof of receipt.  

o On purchase of an entry, You will receive an email confirmation, which is proof of receipt of Your entry to the Prize Draw.  

o Paid and postal entrants will be able to see all valid entries in their online account.  

5. Refunds Policy  

• No refunds for any reason whatsoever will be given for entries to a Prize Draw (unless the refund relates to fraudulent use of a payment card, which is verified to the Promoter by a bank or other financial institution).  

6. Selection of a winner  

• All valid entries will be entered into the Prize Draw and the winner (the “Winner”) will be selected at random using a process that produces verifiably random results.  

• The Winner selection process will be managed by the Promoter 

• Where the Winner selection process is subject to any fault, error or technical failure, the Promoter will be entitled to re-run the draw at its discretion and any such defective result shall be null and void.  

• Where applicable, the selection of a Winner may take place at an Event using the randomly certified selection process provided by the Promoter. 

7. Contacting the Winner  

• After the Prize Draw closes, the Winner will be contacted using the email address or phone number provided by the Entrant in their online account.  

• If the Winner fails to accept the Prize for whatever reason within 72 hours of the Promoter sending them an email, or attempting to contact them by telephone, the Prize will be awarded to another Winner, who will be selected in the same way as the first.  

• The Promoter is not responsible for any failure to make contact the Winner where the Winner has not provided correct contact details in their online account, or the Winner does not respond to emails or telephone calls within 72 hours.  

8. Delivery of the Prize  

• The Promoter will use reasonable endeavours to deliver the Prize to the Winner within 21 days of the Prize Draw taking place.  

• All costs of delivering the Prize to a Winner in the UK will be paid for by the Promoter.  

• If the Winner requires a Prize to be delivered outside the UK, additional charges may apply.  

• On delivery of the Prize to the Winner, all risk and responsibility for insuring the Prize passes to the Winner.  

9. Winner announcement  

• Subject to the Winner’s express consent, the Promoter will announce the full name of the Winner on the Promoter’s website or at an Event.  

• Where consent is not given, only the first name and county of the Winner will be announced.  

9. Publicity  

• Subject to the Winner’s express consent, a Winner may be asked to provide their photograph or to participate in publicity relating to the Prize Draw.  

10. Disputes  

• Any disputes or complaints relating to the Prize Draw should be referred to the Promoter at info@pollylop.com. Please include the details of the Prize Draw, the Promoter and the nature of the complaint and we, the Promoter, will respond within 14 days.  

• If Your query or complaint relates to a data protection issue, please email us at info@pollylop.com providing all details  

11. Limitation of Liability  

• Insofar as permitted by law, the Promoter is not responsible or liable for any loss, damage or personal injury or death occurring as a result of entering a Prize Draw or accepting a Prize, except where it is caused by the gross negligence of the Promoter, distributors or employees.  

• The Promoter acting reasonably reserves the right to void, suspend, cancel or amend the Prize Draw where it becomes necessary to do so.  

• In no event shall the Promoter (including their employees, affiliates and volunteers) be liable for any claim, demand or damages arising out of or in any way connected with the Entrant’s use of the website, the Prize Draw or their receipt and use or enjoyment of a Prize.  

• The Promoter will not accept responsibility for any postal entries that are lost, mislaid, damaged or delayed in transit, unless such event is caused by negligence of the Promoter.  

12. Management Fee  

• The Promoter will charge a fee of up to 10% of the cost of each paid entry for the marketing and operation of the Prize Draw, which includes costs associated with card payment fees and providing the system to enable the Prize Draw to take place.  

13. Applicable Law  

• These terms and conditions shall be governed by English Law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.  

14. Personal data  

• The Promoter will process Your personal data specifically for the purpose of administering the Prize Draw and to contact the Winner at the close of a Prize Draw, to give details of the Prize and to arrange delivery of the Prize.

• The Promoter payment provider will securely store Your card details and other personal information and is PCI compliant. The Promoter will not hold or store any of Your payment details and will not be liable for any loss relating to the storage and security of such details.
